Terms and Conditions of Veto Sports (Trading as GSM International Pty. Ltd.)

PLACING ORDERS ON THE PLATFORM 

HOW TO ORDER

You need an e-mail address to place an order, and you may need to set your browser to accept both (functional) cookies and pop-ups to be able to use all the functionalities of the Veto Sports website, which includes customising stock items, adding items to your shopping cart, and submitting your order. 

When you submit an order, we will send you an email acknowledging receipt of your order.  Our acceptance of the order takes place when the Products are shipped to you – we will send you an email confirming that the Products have been shipped (“Order Confirmation”). If we are unable to supply you with a certain product, we will inform you of this in writing via e-mail and will not process the order. 

OUR RIGHT TO REJECT YOUR ORDER

Fulfillment of all orders on the Veto Sports website is subject to availability. We explicitly reserve the right not to accept your order for any reason. We also reserve the right to cancel an online order by written notice to you in the following situations, without being liable for any damage or costs other than repayment of any amount received from you in relation to the online order we cancelled:

DATA CHECK

When you send us your order, we may run some checks on it before it is fulfilled. These checks may include verifying your address and checking for fraud.  We run partly automated checks on all purchases to filter out unusual or suspect transactions, or transactions which can be identified as susceptible to fraud. Suspected fraud on the Veto Sports website will be investigated and if necessary prosecuted. 

TITLE TRANSFER & RISK OF LOSS

Except for products picked up at the Veto Sports Head Office/Showroom, the title and risk of loss for products purchased from Veto Sports pass to you upon our delivery to the carrier.  Title and risk of loss for products purchased online and picked up at the Veto Sports Head Office/Showroom will pass to you upon your authorized receipt of those products.  Title to product(s) will not transfer until full payment has been received.

PRICES & PAYMENTS

PAYMENT METHODS

We do not accept any method of payment other than those listed below. Please do not try to pay by any other way than specified there. If you do, we will not be liable for loss of the payment or any other damages that may result from this action. Orders must be accompanied by payment in full.

PAYMENT PROCESSING

By paying by credit/debit card, we will deduct the amount due from your account as soon as your order is placed.  If you pay by bank transfer (only available for some orders – e.g. Bulk Orders/Items, we will start delivery after we receive your payment. This may take several days. If no payment has been received within 12 calendar days after you submitted your order, your purchase will automatically be cancelled.  Payments can only be processed if the billing information can be verified.

PRICES AND CURRENCY

Prices for all products on this website are in Australian dollars ($A) and include GST (10%). All prices are correct at the time of publication of this website. Veto Sports reserves the right to alter prices for any reason. Veto Sports will provide Tax Invoices for all accepted orders.

If you change the country of delivery while browsing or during check out, prices from that moment may be quoted in a different currency. Please note that changing the country of delivery may have an influence on the price due to a change in currency or to country specific pricing. 

YOUR TOTAL PRICE

The total price specified in the final check out screen includes GST (10%) and shipping costs. This price will be recorded in the Order Confirmation, which we recommend you print or download for future reference. If paying by credit card, the total amount for your entire order will be reflected on your statement.

PRICE CHANGES

The prices of the products will be as displayed on the Veto Sports website. Prices may change from time to time, but changes will not affect any order which we have confirmed in an Order Confirmation. 

SHIPPING & DELIVERY

DELIVERY – WHERE AND WHEN

Your order will be dispatched within 72 hours from receipt of order. If for any reason we cannot fill your order, support staff will contact you within 7 working days.

Veto Sports will dispatch your goods in the most efficient and reliable manner. This will be done at our sole discretion.

We do not ship on certain public holidays. We do not operate our dispatch centre on weekends. We can only fulfill an order to a delivery address which is a home or office address, we do not deliver to PO Boxes.

SPLIT DELIVERY

Where possible, we try to deliver all items which you have ordered at the same time. However, please note that some products that require customization (such as embroidery) may result in split shipments. 

We reserve the right to split the delivery of your order, for instance if part of your order is delayed or unavailable. If we split your order, we will notify you of our intention to do so by sending you an e-mail to the e-mail address provided by you at the time your order was placed. You will not be charged for any additional delivery costs. 

INSPECTION UPON DELIVERY

Upon delivery, please inspect the packaging for damage. If it appears that the products are damaged, please do not accept the shipment.

RETURNS & CANCELLATIONS

CANCELLING AN ORDER BEFORE DELIVERY

You may cancel an order if it has not yet been shipped. We begin processing orders placed at our online store almost immediately. If you wish to cancel your order, please contact Veto Sports directly at admin@vetosports.com and ensure you have your Order Number details included.

If the status of your order is “Pending” or “Backorder” you may cancel your order by contacting Veto Sports directly. Veto Sports support staff will request a cancellation of your order at our warehouse. If successful, they will send you an email. If cancellation is not possible, the product(s) will be delivered to you and may be returned in accordance with the procedure set out below. 

RETURNING ORDERS AFTER DELIVERY – DEFECTIVE PRODUCTS

We will happily accept product returns and provide you with an exchange, refund, or repair where:

For faults of a minor nature, we reserve the right to offer repair only. Please provide proof of purchase when seeking to return goods.

You are entitled to return products delivered to you if they are defective or otherwise not in conformity with your order when you received them. If the product is faulty or does not conform to specifications, please return it to Veto Sports in the original condition within 7 days of receipt. The returned products may be replaced, refunded, or credited. Freight charges on returns are not refundable. Freight will not be charged when sending any replacement products.

For faulty bulky Items such as Goals, please contact Veto Sports directly to organise a replacement product, repair, spare parts, or a refund.

ORDERS WITH PRODUCT SHORTAGES

If you receive an order with shortages, please contact Veto Sports to arrange for delivery of the product shortage. You will need to provide full details of the fault or shortage along with the invoice number.

REFUND INFORMATION

All refund rights under both state and commonwealth law apply.

Refunds will be issued based on the original form of payment. If you paid via bank transfer you need to give this information to Customer Service when you initiate the return so that we can refund the money directly to your account. 

EVENTS OUTSIDE OUR CONTROL

An Event Outside Our Control means any act or event beyond our reasonable control, including without limitation strikes, lockouts or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic, or other natural disaster, or failure of public or private telecommunications networks. 

If an Event Outside Our Control takes place that affects the performance of our obligations under these Terms of Sale:

a)     We will contact you as soon as reasonably possible to notify you; and

b)     Our obligations under these general conditions will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. 

Where the Event Outside Our Control affects Our delivery of a product to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.  You may cancel the contract if an Event Outside Our Control takes place and you no longer wish us to provide the products. Please see your cancellation rights under Cancellation above. 

OTHER IMPORTANT TERMS

Each of the paragraphs of this Terms and Conditions operates separately. If any court or relevant authority decides that any of them are unlawful or unenforceable, the remaining paragraphs will remain in full force and effect.

If we fail to insist that you perform any of your obligations under these Terms and Conditions, or if we do not enforce our rights against you, or if we delay in doing so, that will not mean that we have waived our rights against you and will not mean that you do not have to comply with those obligations. 

If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you. We will not file a copy of the contract between us. 

Mobile Terms of Service

The Veto Sports mobile message service (the “Service”) is operated by Veto Sports (“Veto Sports”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Veto Sports’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Veto Sports through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. The service will include promotional messages such as promotions, specials, coupons, and other marketing offers; it will also include transactional messages such as order updates and account alerts.

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Veto Sports. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to Veto Sports or click the unsubscribe link (where available) in any text message to cancel. You’ll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Veto Sports mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

PRIVACY POLICY

At Veto Sports we are committed to the protection of your personal information. The information we collect from you is for the purposes of providing you with the products you have ordered, and for invoicing. We may also use the information to promote products to you which we consider to be of interest. We will stop promoting to you if you contact us and tell us not to do so or unsubscribe from our mailing list. Veto Sports will not sell or pass on any of your information to third parties unless required to do so by legislation.
